The Constitution of the Republic of China (Taiwan) is the supreme law of the Republic of China (Taiwan). It was adopted on December 25, 1946, and has been amended several times since then. The Constitution establishes the framework for the government of Taiwan and guarantees the rights and freedoms of its citizens.

The Preamble

The Preamble to the Constitution states the purpose of the Constitution and the principles on which it is based. The Preamble declares that the Constitution is "based on the Three Principles of the People, namely, Nationalism, Democracy, and Social Well-being." The Preamble also states that the Constitution is "a sacred and inviolable pact between the people and the government." It commits the government to "protect the rights and freedoms of the people and to promote social well-being."

The Fundamentals

The Fundamentals of the Constitution are the basic principles on which the government of Taiwan is based. The Fundamentals include the following principles:

  • The Republic of China is a democratic country.
  • The government of Taiwan is divided into three branches: the executive branch, the legislative branch, and the judicial branch.
  • The President of Taiwan is the head of state and the head of the executive branch.
  • The Legislative Yuan is the highest legislative body in Taiwan.
  • The Judicial Yuan is the highest judicial body in Taiwan.

The Rights and Freedoms

The Constitution guarantees the rights and freedoms of the people of Taiwan. The rights and freedoms include the following:

  • The right to life, liberty, and property.
  • The right to freedom of speech, press, and assembly.
  • The right to religion.
  • The right to vote.
  • The right to a fair trial.

The Amendments

The Constitution has been amended several times since it was adopted in 1946. The amendments have been made to address changes in Taiwan's political and social landscape. The most recent amendment was made in 2005. The amendment revised the provisions on the election of the President and Vice President. It also established a new constitutional court.

The Constitution of the Republic of China (Taiwan) is a living document that has evolved over time to meet the needs of the people of Taiwan. It is a testament to the enduring spirit of democracy and freedom in Taiwan.
